TERMS AND CONDITIONS
1. DEFINITIONS AND PARTIES
THE COMPANY / LESSOR: HERMANOS VALERIO RENT CAR (HV RENT CAR).
CUSTOMER / LESSEE: The natural or legal person signing this contract, who assumes full legal, civil, and financial responsibility for the vehicle, its payments, and strict compliance with these terms.
AUTHORIZED DRIVER: Exclusively the Customer and those persons expressly registered and approved by HV RENT CAR on the front page of this contract.
VEHICLE: The unit identified in this contract, including its keys, tires, tools, license plates, accessories, optional equipment, and documents.
2. REQUIREMENTS AND DRIVING CAPACITY: Only Authorized Drivers with a valid, original, and current driver’s license, and a minimum age of 25 (or 23 subject to special conditions and charges) may operate the Vehicle. HV RENT CAR reserves the right to verify identity, scan documents, and deny the rental at its discretion. Providing false information or omitting relevant data will allow HV RENT CAR to immediately terminate the contract, recover the Vehicle, and charge for all incurred expenses.
3. TRANSFER OF LEGAL CUSTODY AND CIVIL LIABILITY (INDEMNITY): Upon receiving the keys, the Customer assumes full custody, use, control, and “legal guard” (guarda jurídica) of the Vehicle in accordance with Article 1384-1 of the Dominican Civil Code. Pursuant to Article 305 of Law No. 63-17, the Customer assumes full and exclusive civil, criminal, and financial responsibility for any damage caused to themselves, their passengers, third parties, or public or private property. The Customer agrees to defend, indemnify, and hold harmless HV RENT CAR, its owners, and affiliates against any lawsuit, claim, loss, or judicial sentence generated during the rental period. If HV RENT CAR is judicially compelled to indemnify a third party, the Customer authorizes the full collection of such amounts and legal fees from their credit card or personal assets.
4. PROHIBITED USES AND AUTOMATIC VOIDING OF COVERAGE: The Vehicle is for personal or lawful business use exclusively on paved and asphalted roads. IT IS STRICTLY PROHIBITED TO: (a) Drive under the influence of alcohol, drugs, narcotics, or medications that alter consciousness; (b) Allow an unauthorized driver to operate the Vehicle; (c) Drive on unpaved roads, off-road, beaches, or rivers; (d) Use the Vehicle for profit (taxi), towing, pushing, or overloading; (e) Participate in competitions or driver training; (f) Tamper with the odometer, GPS, or engine parts; (g) Cross international borders without written authorization. NON-COMPLIANCE: Any violation of these “Prohibited Uses” constitutes a material breach of contract and shall AUTOMATICALLY AND IMMEDIATELY VOID ALL INSURANCE COVERAGES, DAMAGE WAIVERS, AND PROTECTIONS DETAILED IN ANNEX B. In such cases, the Customer shall be 100% liable with their personal assets for the total value of the Vehicle and damages to third parties.
5. DEPOSIT, PAYMENTS, AND AUTHORIZATION OF CHARGES: At the beginning of the rental, a security deposit will be withheld via credit card or cash. The Customer expressly and irrevocably authorizes HV RENT CAR to charge their credit card for all amounts owed under this contract, including, but not limited to: rental fees, extensions, insurance deductibles, uncovered damages, lost keys, loss of use (profits lost for days in the repair shop), administrative fees, towing services, special cleaning, missing fuel, tolls, and traffic fines.
6. RETURN, INSPECTION, AND END OF RESPONSIBILITY: The Customer must return the Vehicle on the agreed date, time, and location, in the same condition as indicated in the initial inspection report, except for normal wear and tear. After-hours Return: If HV RENT CAR authorizes the Customer to return or abandon the Vehicle outside of business hours or without the presence of company personnel, the Customer remains solely legally and financially responsible for the Vehicle, its keys, and any damage, loss, or theft until HV RENT CAR personnel perform the formal physical inspection during the following business hours.
7. VEHICLE RECOVERY AND TECHNOLOGY: Unauthorized delay in returning the vehicle generates additional charges. HV RENT CAR reserves the absolute right to treat the failure to return the vehicle as illegal appropriation and report it to the authorities. Furthermore, HV RENT CAR is authorized to use GPS tracking technology and remotely immobilize the engine to regain possession of the Vehicle without prior notice; all recovery costs shall be the exclusive responsibility of the Customer.
8. ACCIDENTS, BREAKDOWNS, AND THEFT: In case of an accident, theft, or breakdown, the Customer must immediately notify HV RENT CAR and the Police (DIGESETT). The Vehicle must not be moved without authorization from the authorities. It is strictly mandatory to submit the Police Report within 24 hours of the event for any coverage in Annex B to be valid. The Customer must not admit liability to third parties without consulting the company.
9. FINES, TOLLS, AND ADMINISTRATIVE CHARGES: All fines, violations of Law 63-17, and tolls generated during the rental period are the exclusive responsibility of the Customer. HV RENT CAR may pay these violations to protect its property and charge them to the Customer’s credit card, adding an administrative fee for the management.
10. FUEL AND MILEAGE: A Full-to-Full policy applies. If the Vehicle is returned with less fuel than provided, the value of the missing fuel plus a refueling service fee will be charged. Mileage is unlimited per day, unless the front page of the contract establishes a different agreement.
11. CLEANING AND NO SMOKING POLICY: The Vehicle is delivered clean and must be returned in acceptable condition. SMOKING or VAPING inside the Vehicle is STRICTLY PROHIBITED. A special cleaning and deodorization fee of $70.00 TO $100.00 USD will be applied if evidence of smoke is detected, or if the Vehicle is returned with extreme dirt, stains, or pet hair.
12. PERSONAL ITEMS: HV RENT CAR assumes no responsibility for damage, theft, or loss of personal items, money, or merchandise left, stored, or transported in the Vehicle, either during the rental period or after its return.
13. JURISDICTION AND CANCELLATIONS: This contract is governed exclusively by the laws of the Dominican Republic. For any legal dispute, the parties submit to the jurisdiction of the courts of the main domicile of HV RENT CAR. Cancellations are governed by the policies published at HVRENTCAR.COM.
14. DECLARATION AND SIGNATURES: The Customer declares to have read, understood, and accepted in their entirety these General Terms and Conditions, acknowledging that together they constitute the entire agreement with the force of law between the parties.
